These General Terms and Conditions of Contract (hereinafter, the \u201cTerms\u201d) govern the purchase of products through the website https:\/\/shop.ladaurada.com (hereinafter, the \u201cWebsite\u201d), owned by ONA BEACH CLUB, S.L.<\/strong><\/p>\n\n

Placing an order through the Website implies express, full and unreserved acceptance of these Terms by the User who acquires the status of buyer (hereinafter, the \u201cCustomer\u201d). Before completing the order, the Customer must read and accept these Terms by ticking the corresponding box.<\/p>\n\n

2. Purpose<\/h2>\n\n

The purpose of these Terms is to regulate the contractual sale-purchase relationship between the Seller and the Customers who purchase products through the Website. The products marketed are, principally:<\/p>\n\n

    \n
  • Merchandising:<\/strong> textile items, accessories and promotional items bearing the \u201cLa Daurada\u201d and \u201cLa Daurada Group\u201d brands.<\/li>\n\n\n\n
  • Gift vouchers (digital, in PDF):<\/strong> documents redeemable for catering services at the Seller’s establishments, in accordance with the specific conditions of each voucher set out in Annex I<\/strong> to these Terms.<\/li>\n<\/ul>\n\n

    3. Capacity to contract<\/h2>\n\n

    To place an order through the Website, the Customer must be of legal age (18 years old) and have full legal capacity to enter into a contract. The Customer declares that all information provided during the purchase process is truthful, accurate and complete.<\/p>\n\n

    4. Geographic availability<\/h2>\n\n

    The Seller ships exclusively within mainland Spain<\/strong>. Orders to the Balearic Islands, Canary Islands, Ceuta, Melilla or other countries cannot be processed through the standard system; if interested, the Customer may contact info@ladaurada.es beforehand to assess the possibility of a special shipment.<\/p>\n\n

    Additionally, the Customer may choose the in-store pickup<\/strong> option, at the Seller’s establishment located on Moll de Ponent in Vilanova i la Geltr\u00fa, at no shipping cost.<\/p>\n\n

    5. Purchase process<\/h2>\n\n

    5.1. Product selection:<\/strong> the Customer adds the desired products to the cart, selecting, where applicable, the relevant options (size, voucher amount, etc.).<\/p>\n\n

    5.2. Identification:<\/strong> the Customer provides the information required to process the order (name, shipping address, billing address, email, phone number). Purchases are made as a guest<\/strong>, with no need to create a user account.<\/p>\n\n

    5.3. Shipping method:<\/strong> the Customer selects a shipping method from the available options (home delivery via GLS or in-store pickup).<\/p>\n\n

    5.4. Payment method:<\/strong> the Customer selects one of the enabled payment methods (see section 7).<\/p>\n\n

    5.5. Confirmation:<\/strong> before completing the order, the Customer reviews a summary of it and, after reading and accepting these Terms and the Privacy Policy, confirms the purchase.<\/p>\n\n

    5.6. Order receipt:<\/strong> once payment has been completed, the Customer will receive a confirmation email with the order details, which serves as proof that the contract has been formalised. The invoice will be issued in electronic format.<\/p>\n\n

    6. Prices and availability<\/h2>\n\n

    Prices shown on the Website are expressed in euros (\u20ac)<\/strong> and include applicable Value Added Tax (VAT). Shipping costs will be shown separately before the order is completed.<\/p>\n\n

    The Seller reserves the right to modify prices at any time, although products will be invoiced at the price in force at the time the order is placed.<\/p>\n\n

    Product offers and availability may vary. In the exceptional event that a product is unavailable after an order has been placed, the Seller will notify the Customer as soon as possible and will refund in full the amounts paid, with no penalty whatsoever.<\/p>\n\n

    7. Payment methods<\/h2>\n\n

    The Customer may pay for the order using any of the following methods, all of which are processed through the MONEI Digital Payments, S.L.<\/strong> payment gateway:<\/p>\n\n

      \n
    • Credit or debit card (Visa and Mastercard)<\/li>\n\n\n\n
    • Apple Pay<\/li>\n\n\n\n
    • Google Pay<\/li>\n\n\n\n
    • Bizum<\/li>\n<\/ul>\n\n

      The Seller does not store the Customer’s card or banking details, which are processed directly by MONEI under PCI-DSS security standards.<\/p>\n\n

      If an undue or unrecognised charge is detected, the Customer must report it to the Seller via info@ladaurada.es as soon as possible.<\/p>\n\n

      8. Shipping and delivery<\/h2>\n\n

      8.1. Carrier:<\/strong> shipments of physical products are carried out through GLS Spain Operations, S.L.U.<\/strong>, using its BusinessParcel (24\/48 hours)<\/strong> service.<\/p>\n\n

      8.2. Delivery time:<\/strong> the Seller will prepare the order within 1 to 2 business days<\/strong> of payment confirmation. Once handed over to the carrier, the usual delivery time is 24 to 48 business hours<\/strong> within mainland Spain. The total estimated time from placing the order is therefore 2 to 4 business days<\/strong>.<\/p>\n\n

      Delivery times are estimates and do not constitute a contractual obligation of an essential term, unless expressly agreed otherwise. The Seller will not be liable for delays caused by circumstances beyond its control (strikes, adverse weather conditions, force majeure, etc.).<\/p>\n\n

      8.3. Shipping costs:<\/strong> shipping costs for home delivery (GLS BusinessParcel) depend on the destination area and amount, per order and VAT included, to \u20ac4.80<\/strong> in the province of Barcelona, \u20ac5.77<\/strong> in the rest of Catalonia and \u20ac7.12<\/strong> in the rest of mainland Spain. Orders with the in-store pickup option incur no shipping cost.<\/p>\n\n

      8.4. In-store pickup:<\/strong> Customers who choose in-store pickup will be notified by email once the order is available. Pickup will take place at the Seller’s establishment during business hours. If the order is not collected within 30 calendar days<\/strong> of the availability notification, the Seller reserves the right to cancel the order and refund the product amount, deducting any justified handling costs.<\/p>\n\n

      8.5. Receipt of the order:<\/strong> upon delivery, the Customer must check that the packaging is in good condition. If visible damage is observed, it must be noted on the carrier’s delivery note and reported to the Seller within a maximum of 24 hours<\/strong>.<\/p>\n\n

      8.6. Gift vouchers:<\/strong> gift vouchers are delivered in digital format (PDF) by email automatically after payment confirmation. Digital delivery is immediate and incurs no shipping cost.<\/p>\n\n

      9. Right of withdrawal<\/h2>\n\n

      9.1. Time limit and method of exercise:<\/strong><\/p>\n\n

      In accordance with Article 102 et seq. of Royal Legislative Decree 1\/2007, of 16 November (TRLGDCU), Customers who qualify as consumers and users have the right to withdraw from the contract within a period of fourteen (14) calendar days<\/strong> without needing to give a reason, counted:<\/p>\n\n

        \n
      • For contracts for goods (merchandising): from the day on which the Customer, or a third party indicated by the Customer other than the carrier, takes physical possession of the goods.<\/li>\n\n\n\n
      • For contracts for the provision of services (unredeemed gift vouchers): from the day the contract was concluded.<\/li>\n<\/ul>\n\n

        To exercise the right of withdrawal, the Customer must notify the Seller of their decision by an unequivocal statement sent to info@ladaurada.es<\/strong> or by post to the Seller’s address. The Customer may use the withdrawal form template provided as Annex II<\/strong> to these Terms, although its use is not mandatory.<\/p>\n\n

        9.2. Consequences of withdrawal:<\/strong><\/p>\n\n

        In the event of withdrawal, the Seller will refund the Customer all payments received, including delivery costs (with the exception of additional costs resulting from the Customer’s choice of a delivery method other than the least costly standard delivery method offered by the Seller), without undue delay and, in any event, within a maximum of fourteen (14) calendar days<\/strong> from the date on which the Seller is informed of the decision to withdraw.<\/p>\n\n

        The refund will be made using the same payment method used by the Customer for the initial transaction, unless the Customer has expressly agreed otherwise and provided this does not entail any additional cost.<\/p>\n\n

        The Seller may withhold the refund until it has received the goods back, or until the Customer has provided proof of having returned them, whichever condition is met first.<\/p>\n\n

        9.3. Return of goods:<\/strong><\/p>\n\n

        The Customer must return the goods without undue delay and, in any case, within a maximum of fourteen (14) calendar days<\/strong> from the date on which they communicate their decision to withdraw. The goods must be sent to the Seller’s address indicated in section 1.<\/p>\n\n

        The direct cost of returning the goods shall be borne by the Customer.<\/strong><\/p>\n\n

        The Customer shall only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics or functioning.<\/p>\n\n

        9.4. Exceptions to the right of withdrawal:<\/strong><\/p>\n\n

        In accordance with Article 103 of the TRLGDCU, the right of withdrawal does not apply<\/strong> to contracts relating to:<\/p>\n\n

          \n
        • Goods made to the consumer’s specifications or clearly personalised<\/strong>, such as may be the case with the \u201cPersonalised Gift Voucher\u201d once it has been issued with a specific amount and\/or recipient requested by the Customer.<\/li>\n\n\n\n
        • The provision of services, once the service has been fully performed<\/strong>, when performance began with the consumer’s prior express consent.<\/li>\n\n\n\n
        • The supply of services<\/strong> once the gift voucher has been redeemed at the establishment, for the portion corresponding to the service actually provided.<\/li>\n\n\n\n
        • The supply of digital content not supplied on a tangible medium when performance began with the consumer’s prior express consent and acknowledgement that they thereby lose their right of withdrawal.<\/li>\n<\/ul>\n\n

          10. Cancellations, exchanges and returns<\/h2>\n\n

          10.1. Size exchange for merchandising:<\/strong> in addition to the legal right of withdrawal, the Seller offers the possibility of a size exchange<\/strong> for textile items, provided the product is in perfect condition, unused, with its original labelling and original packaging. The Customer must request the exchange within 14 calendar days of receiving the order, by writing to info@ladaurada.es.<\/p>\n\n

          The cost of shipping the original item back to the Seller shall be borne by the Customer. The Seller will bear the cost of shipping the new size to the Customer.<\/p>\n\n

          10.2. Defective or non-conforming products:<\/strong> if the Customer receives a defective, damaged product or one that does not match their order, they must report it to the Seller within a maximum of 30 calendar days<\/strong> of receipt, by writing to info@ladaurada.es and, if possible, attaching photographs of the defect. The Seller will proceed, as appropriate, to replace the product, repair it, reduce the price or terminate the contract with a full refund, in accordance with Articles 114 et seq. of the TRLGDCU. In these cases, return costs will be borne entirely by the Seller.<\/strong><\/p>\n\n

          10.3. Return of unredeemed gift vouchers:<\/strong> gift vouchers that have not been redeemed may be returned by contacting info@ladaurada.es within the 14-day withdrawal period. Once a voucher has been redeemed, in whole or in part, no refund of the amount will be possible.<\/p>\n\n

          10.4. Order cancellation:<\/strong> the Customer may cancel an order free of charge until it has been shipped or, for in-store pickup orders, until it has been collected, by writing to info@ladaurada.es or calling +34 938 159 820 and quoting the order number. The Seller will confirm the cancellation by email and refund the full amount, including shipping costs, using the same payment method, within a maximum of fourteen (14) calendar days. If the order has already been shipped, it will be handled as a withdrawal (section 9). Gift vouchers may be cancelled as long as they have not been redeemed, within the period set out in section 10.3.<\/p>\n\n

          11. Legal warranty<\/h2>\n\n

          All products marketed are subject to the legal warranty provided for in Royal Decree-Law 7\/2021, of 27 April, amending the TRLGDCU. The warranty on physical products is three (3) years<\/strong> from delivery for lack of conformity that becomes apparent within that period, unless a different period applies due to the nature of the product.<\/p>\n\n

          The warranty does not cover defects caused by improper use, normal wear and tear, incorrect handling, or causes unrelated to the product.<\/p>\n\n

          12. Out-of-court dispute resolution<\/h2>\n\n

          In the event of a dispute, the Customer may contact the Seller via info@ladaurada.es to attempt an amicable resolution.<\/p>\n\n

          Additionally, in accordance with Article 14 of Regulation (EU) No. 524\/2013, consumer Customers may access the European Commission’s online dispute resolution (ODR) platform<\/strong>: https:\/\/ec.europa.eu\/consumers\/odr\/.<\/p>\n\n

          13. Applicable law and jurisdiction<\/h2>\n\n

          These Terms are governed by Spanish law. For the resolution of any dispute arising from them, the parties submit to the Courts and Tribunals corresponding to the consumer’s domicile, in accordance with consumer protection legislation.<\/p>\n\n

          \n\n

          ANNEX I \u2014 Specific conditions for gift vouchers<\/h2>\n\n

          Gift vouchers sold through the Website are redeemable exclusively for the catering services indicated on each voucher, at the La Daurada establishment, subject to the following specific conditions:<\/p>\n\n

          A. Daily Menu Gift Voucher<\/h2>\n\n
            \n
          • Valid Monday to Friday (midday)<\/strong>, except public holidays.<\/li>\n\n\n\n
          • Includes: starter, main course and dessert.<\/li>\n\n\n\n
          • Any remaining amount or extra consumption will be charged to the Customer at the establishment.<\/li>\n\n\n\n
          • Expiry: 12 months<\/strong> from the date of issue.<\/li>\n\n\n\n
          • Booking required<\/strong>, by calling 938 159 820 and indicating that you hold a voucher.<\/li>\n\n\n\n
          • The voucher (physical or digital) must be presented on arrival at the establishment.<\/li>\n<\/ul>\n\n

            B. Rice Menu Gift Voucher<\/h2>\n\n
              \n
            • Minimum 2 people.<\/strong><\/li>\n\n\n\n
            • Valid every day of the week, at midday.<\/li>\n\n\n\n
            • Includes per person: starter, main course (rice), dessert and the first drink.<\/li>\n\n\n\n
            • All menus include water. Also one bottle of wine per 4 people. Ask about other options.<\/li>\n\n\n\n
            • Any allergy must be specified up to 48 hours before<\/strong> the booking so that an alternative menu can be offered. Ask staff about the allergens contained in our dishes.<\/li>\n\n\n\n
            • Any remaining amount or extra consumption will be charged to the Customer at the establishment.<\/li>\n\n\n\n
            • Expiry: 12 months<\/strong> from the date of issue.<\/li>\n\n\n\n
            • Booking required<\/strong>, by calling 938 159 820 and indicating that you hold a voucher.<\/li>\n\n\n\n
            • The voucher (physical or digital) must be presented on arrival at the establishment.<\/li>\n<\/ul>\n\n

              C. Personalised Gift Voucher<\/h2>\n\n
                \n
              • Valid every day of the week (midday and evening), according to the establishment’s opening hours.<\/li>\n\n\n\n
              • Voucher redeemable for menu items up to the total value of the voucher.<\/li>\n\n\n\n
              • Any consumption exceeding the voucher amount must be paid separately at the establishment.<\/li>\n\n\n\n
              • If consumption is lower than the voucher amount, no refund of the difference will be given, nor will the remaining balance be saved<\/strong> for another occasion.<\/li>\n\n\n\n
              • Not redeemable for cash.<\/strong><\/li>\n\n\n\n
              • Expiry: 12 months<\/strong> from the date of issue.<\/li>\n\n\n\n
              • Booking required<\/strong>, by calling 938 159 820 and indicating that you hold a voucher.<\/li>\n\n\n\n
              • The voucher (physical or digital) must be presented on arrival at the establishment.<\/li>\n<\/ul>\n\n

                D. Conditions common to all vouchers<\/h2>\n\n
                  \n
                • Vouchers are for single use<\/strong> and cannot be combined with other promotions, discounts or offers, unless expressly stated otherwise.<\/li>\n\n\n\n
                • Vouchers are transferable<\/strong> by the original Customer to the bearer, except for the Personalised Gift Voucher when it has been expressly issued as non-transferable\/named.<\/li>\n\n\n\n
                • Loss, theft, damage or improper copying of the voucher does not give rise to a right to its replacement or to a refund of the amount paid, except in cases provided for by law.<\/li>\n\n\n\n
                • Once the expiry period has elapsed, the voucher will lose its validity with no right to a refund, except as provided by applicable legislation on the limitation of obligations.<\/li>\n\n\n\n
                • The Seller reserves the right not to accept vouchers that have been manifestly altered or forged.<\/li>\n<\/ul>\n\n
                  \n\n
